Interpretation

Words with the initial letter capitalized have meanings defined under the following conditions. These definitions apply whether the words appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.

  • Device means any device that can access the Service such as a computer, cellphone, or digital tablet.
  • Service refers to the Website and any related features, pages, forms, and tools provided on it.
  • Terms means these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-Party Services means any services, content, data, information, products, or services provided by a third party that may be displayed, included, linked, or made available by the Service.
  • Website refers to Marriage In Nigeria, accessible from https://marriageinnigeria.ng/
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • User Content means any content submitted, uploaded, posted, provided, or transmitted through the Service by You, including business information, images, logos, descriptions, reviews, messages, and any other materials.
  • Vendor means any individual or business that is listed on the Service or submits information to be listed on the Service, including planners and service providers.

Acknowledgment

These are the Terms governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding use of the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access or use the Service.

You represent that You are at least 18 years old. The Company does not permit persons under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy. Please read our Privacy Policy carefully before using our Service.

What the Service Is (And Is Not)

Marriage In Nigeria is a directory and discovery platform that may display Vendor listings, profiles, content, and wedding-related requests/leads.

  • The Company does not provide wedding services, and is not a party to any agreement between a Vendor and a client/couple.
  • Any engagement, negotiation, pricing, delivery, and service performance is strictly between the Vendor and the client/couple.
  • The Company does not guarantee that a Vendor will respond, that a client/couple will hire a Vendor, or that any listing/request will lead to business outcomes.
  • Inclusion of a Vendor on the Service does not mean endorsement, certification, or guarantee by the Company.

Accounts, Listings, and Communications

  1. Accuracy of information. You agree to provide accurate and up-to-date information when submitting a listing, inquiry, or any other information through the Service.
  2. Drafted profiles. Vendor profiles may be created using information provided directly by Vendors and/or publicly available business information. Vendors are encouraged to review and correct their profiles where applicable.
  3. Emails/phone numbers. Where contact details are collected or displayed, You agree that:
    • You will not use contact details for spam, harassment, or unsolicited marketing that violates applicable law.
    • You will not scrape, harvest, or compile contact details from the Service.
  4. Notifications. We may send service-related notifications (e.g., verification, updates, security notices) using contact details provided.

User Content

1) Ownership

You retain ownership of Your User Content.

2) License to the Company

By submitting User Content through the Service, You grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, publish, display, distribute, and modify (for formatting and presentation purposes only) such User Content for the operation, improvement, and promotion of the Service.

3) Your responsibilities

You represent and warrant that:

  • You own or have the necessary rights, permissions, and licenses to submit the User Content;
  • Your User Content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights);
  • Your User Content is not unlawful, defamatory, misleading, deceptive, or harmful.

4) Content moderation and removal

We may (but are not obligated to) monitor, review, remove, or restrict any User Content at our sole discretion, including content we believe violates these Terms, applicable law, or may harm the Service or other users.

Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To post false, misleading, or impersonating information (including fake listings or fake reviews)
  • To harass, abuse, threaten, defame, intimidate, or harm any person or business
  • To transmit spam, unsolicited marketing, or bulk messaging
  • To scrape, harvest, crawl, or automatically collect data (including emails and phone numbers) from the Service
  • To use bots, scripts, or automated systems to access, search, submit, or interact with the Service without our written permission
  • To attempt to bypass security, access controls, rate limits, or restrictions
  • To reverse engineer, decompile, or attempt to extract source code or underlying ideas from the Service
  • To upload viruses, malware, or any harmful code
  • To interfere with or disrupt the Service, servers, or networks

We may take any action we consider appropriate if You violate this section, including suspension or termination.

Intellectual Property

The Service and its original content (excluding User Content), features, functionality, branding, logos, and design elements are and will remain the exclusive property of the Company and its licensors.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Company’s materials, except as incidentally necessary to use the Service as intended.

Links to Other Websites

Our Service may contain links to Third-Party Services that are not owned or controlled by the Company.

The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any Third-Party Services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any Third-Party Services.

We strongly advise You to read the terms and privacy policies of any Third-Party Services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately.

Disclaimer for Listings, Requests, and Outcomes

To the maximum extent permitted by applicable law:

  • Listings, profiles, requests, budgets, availability, and other information on the Service may be provided by Users/Vendors or derived from public information and may be incomplete, outdated, or inaccurate.
  • The Company does not verify or guarantee the identity, licensing, permits, quality, suitability, safety, or legality of any Vendor or services offered by Vendors.
  • Any reliance You place on information on the Service is at Your own risk.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind.

To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limitation, the Company makes no warranty that:

  • the Service will meet Your requirements,
  • the Service will be uninterrupted, timely, secure, or error-free,
  • the information on the Service will be accurate, reliable, or current,
  • defects will be corrected, or
  • the Service or its servers are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to You. In such cases, exclusions will apply to the greatest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by applicable law:

  1. Free Service; $0 cap. Since You do not pay anything to use the Service, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy, shall be limited to $0.
  2. Exclusion of certain damages. In no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, loss of profits, loss of data, business interruption, personal injury, loss of privacy, or any other loss) arising out of or in any way related to the use of or inability to use the Service, Third-Party Services, or any interactions or transactions between Users and Vendors, even if the Company has been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to You. In such cases, the Company’s liability will be limited to the greatest extent permitted by law.

Indemnity

You agree to defend, indemnify, and hold harmless the Company, its Affiliates, directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service,
  • Your User Content,
  • Your violation of these Terms,
  • Your violation of any law or third-party right, or
  • any dispute between You and another user, Vendor, or third party.

Governing Law

The laws of Nigeria, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Dispute Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

If the dispute is not resolved informally, You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought in the courts of competent jurisdiction in Nigeria, unless applicable law requires otherwise.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

The failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter, and the waiver of a breach shall not constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may be translated if We make them available on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
